Terms and Conditions
- Scope:
These delivery terms become valid upon acceptance of our order confirmation, regardless of any existing, differing purchasing terms of the customer. Deviations from this require written form. - Prices / Delivery Time:
a) Prices are ex works Radevormwald plus the applicable VAT at the time of invoicing. The price stated in the order confirmation is binding.
b) The delivery time stated in the order confirmation applies. Sudden changes in raw material delivery times are not the responsibility of Schlicker GmbH. - Transfer of Risk:
Delivery is ex works including packaging. Risk is transferred to the buyer upon handover of the goods to the carrier. - Warranty:
a) The statutory warranty claims apply.
b) Obvious defects must be reported immediately after receipt of the goods, including representative samples and shipping data.
c) Hidden defects must be reported immediately upon discovery, including representative samples and shipping data.
d) In the case of justified complaints, Schlicker GmbH will provide a free replacement with defect-free goods. After two unsuccessful repair attempts, the buyer has the right to a price reduction or to withdraw from the purchase.
e) Returns or repair attempts may only be carried out with the written consent of Schlicker GmbH.
f) Our warranty obligations automatically expire if the goods leave the country where the customer is based.
- Payment Terms:
Invoices are payable net within 30 days.
Schlicker GmbH reserves the right to suspend deliveries to the customer in the event of non-payment. The goods remain the property of Schlicker GmbH until full payment has been received.
- Liability:
Schlicker GmbH is only liable to the extent covered by its liability insurance with Allianz.
- Tools:
We provide free maintenance, storage, and servicing of tools used at our facility on behalf of the customer. Modifications, partial renewals, and repairs are carried out in agreement with the customer and invoiced accordingly.
- Jurisdiction:
The place of jurisdiction is that of either the buyer or the seller. German law exclusively applies.
